Terms of service

These terms are an agreement between you and remarQable LLC (“we”, “us”), which runs AikNote at aiknote.com and in the AikNote apps. By using AikNote, with or without an account, you agree to them. If you don’t agree, please don’t use it. How we handle your data is in our privacy policy.

Who can use AikNote

You must be at least 13, or 16 where the law asks for that, and able to agree to these terms. If you use AikNote for an organization, you agree for it too.

Your account

Keep your sign-in safe; you’re responsible for what happens under your account. You can try AikNote without an account; a guest account is limited to a few notes and is deleted after 30 days without use. Signing in keeps what you wrote.

Your notes are yours

You keep every right you have in what you put into AikNote. You give us permission to store, copy, process and show it only as needed to run AikNote for you: for example to make its card, search it, answer your questions, and show it to the people you share it with. That includes sending it to the companies listed in our privacy policy that do this work for us. This permission ends when you delete the content, apart from copies in backups until they expire.

You’re responsible for what you put in, and you must have the right to put it there.

Use it fairly

Don’t use AikNote to:

• break the law, or store or share content that is illegal, including any that sexually exploits children;
• infringe anyone’s copyright, privacy or other rights;
• harass, threaten or deceive people, or spread malware or spam through share links;
• get around its limits, probe or attack its security, or put an unreasonable load on it, including by automated scraping;
• resell it, or copy it to build a competing service.

We may remove content or suspend accounts that break these rules, and we’ll tell you when we can.

AI can be wrong

AikNote uses AI to write cards, file notes and answer questions. What it writes can be incomplete or wrong. Check anything that matters against your original note, and don’t rely on it for medical, legal, financial or safety decisions.

Links, videos and other apps

When you drop in a link or video, AikNote reads it to make your card. You’re responsible for following the rules of the sites you save from. If you connect another app (such as Claude or ChatGPT) to your notes, its use is governed by its own terms, and you can disconnect it at any time.

Sharing

Anyone who has a share link you make can open that note, and edit it if you allowed that, until you turn the link off. Share carefully.

The service

AikNote is free for now. It has limits on how much you can store and how much AI you can use, and we may change them. We may add, change or remove features, or stop AikNote altogether; if we stop it, we’ll give you notice and time to download your notes. We may introduce paid plans; we won’t charge you without your agreement.

We work to keep your notes safe, but please keep your own copy of anything you can’t afford to lose. You can download all your notes from Settings at any time.

Ending

You can stop using AikNote and delete your account at any time from Settings. We may suspend or end your access if you break these terms, or if the law requires it. The sections on your content, disclaimers, liability and disputes still apply after that.

Disclaimers

AikNote is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, including that it will be uninterrupted, error-free or fit for a particular purpose, or that content will never be lost.

Limit of liability

To the extent the law allows, remarQable LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue. Our total liability for any claim about AikNote is limited to the greater of what you paid us in the 12 months before the claim and US$50. Some places don’t allow these limits, so they may not apply to you.

Indemnity

If someone makes a claim against us because of content you put in AikNote or your breach of these terms, you agree to cover our reasonable costs from it, including legal fees.

Disputes

These terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Minnesota, and you and we agree to their jurisdiction. If you live in a country whose law gives you the right to bring claims at home, you keep that right.

Changes

We may update these terms. We’ll change the date above, and for a change that matters we’ll tell you in the app before it takes effect. Using AikNote after that means you accept the new terms.

The rest

If any part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You can’t transfer these terms; we can, as part of a sale or merger of our business. These terms and our privacy policy are the whole agreement between us about AikNote.
